There are many individual pending lawsuits relating to vaginal mesh, but no pending class action lawsuits. Class action lawsuits are rarely used in personal injury and defective medical device cases. Instead, many individual cases are filed, and sometimes the court consolidates the pretrial proceedings for those cases. Cases are not filed as class actions. They are individually filed, and they can only be settled with the client’s consent.

       There are too many variables in a personal injury defective medical device case for there to be sufficient similarities to warrant a class action structure.
